Conclusion of sales contracts
The confirmation and sending of the order by the customer ("Customer" means the user of the mysecretcase.com website who accesses the e-commerce check out), according to the instructions that will appear on the web pages from time to time, implies the acknowledgement and full acceptance of these general sales conditions by the customer. The contract of sale between mysecretcase.com and the customer is considered finalized with the acceptance of the order by mysecretcase.com.
If the customer is a consumer (a natural person who buys goods for purposes not related to his professional activity, or makes the purchase by requesting an invoice with a valid VAT number) once the online purchase procedure, will print or save an electronic copy and keep these general conditions of sale, in accordance with the provisions of Article 3 and 4 of D. Decree No. 185/99 on distance selling.
It is excluded any right of the customer to damages or compensation, as well as any contractual or extra-contractual liability for non-acceptance, even partial, of an order.
If, due to misunderstandings or other inconveniences, the price indicated on the site should be lower than the correct selling price of a product, we may contact you to verify whether you still wish to purchase the product at the correct price or we may not accept your order.MySecretCase is committed to offering all necessary assistance to the customer.
Modalities of purchase
The customer can only purchase the products present in the online catalog at the time of placing the order and viewable online at mysecretcase.com as described in the relevant information sheets. The order will be validly processed at the time of receipt on the email box communicated by the customer of the confirmation of the authorization to charge the customer's credit card of the price and any costs for transport and delivery, as better provided for in art. 5.
The image accompanying the description of a product may not be fully representative of its characteristics but differ in color, size, accessories in the picture. All support information for the purchase (Glossary, Guide to purchase, etc. ...) are intended as a simple generic information material, not referable to the real characteristics of a single product.
The correct receipt of the order is confirmed by mysecretcase.com by means of an email reply, sent to the email address provided by the customer. This confirmation message will report the date and time of receipt of the order and a customer order number to be used in any further communication with mysecretcase.com. The message will show all the data entered by the customer, all information relating to the essential characteristics of the good, all 'indication of the price, payment methods, methods and costs of delivery and applicable taxes. The Customer will have to verify the correctness and communicate promptly any corrections, according to the modalities described in this document.
In the case of non-acceptance of the order, mysecretcase.com ensures timely communication to the customer.
Prices
The products will be sold at prices, inclusive of VAT, indicated in the product page online at the time of confirmation of the order by the customer. Delivery costs may be charged to the customer and will appear on the web page of the "order summary". Before the customer confirms the order by clicking on the appropriate button, on the web page will appear the summary of the prices of the products loaded on the cart and delivery costs. These data will then be automatically reproduced in the order form that the customer sends to mysecretcase.com following the order confirmation procedures.
Accounting documents and delivery methods
For each order accepted and carried out, mysecretcase.com issue tax receipt of the material shipped, sending it by e-mail to the holder of the order, pursuant to art 14 D.P.R. 445/2000. For the issuance of tax receipt are the information provided by the customer when ordering. No variation of the fiscal document will be possible, after the emission of the same one. No responsibility can be attributed to mysecretcase.com in case of delay in the order or delivery of the order.
Methods of payment
The customer can make payment by credit card, Pay Pal or cash on delivery. Contextually to the order from the Customer, the bank of reference (in case of payments with credit card) will provide to authorize and to debit the relative amount to the order carried out on the credit card of the Customer. If the customer exercises the right of withdrawal, in the manner defined in Article 6, mysecretcase.com will return the amount previously charged directly to the customer's credit card or PayPal account excluding shipping costs already incurred. In case of payments on delivery, the refund will be made by bank transfer.
At no time during the purchase procedure is mysecretcase.com able to know the information relating to the customer's credit card, transmitted via secure connection directly to the site of the bank handling the transaction and no computer archive of mysecretcase.com will retain such data.
Right of withdrawal
Pursuant to art. 5 DL 185/1999, if the customer is a consumer (ie a person who buys goods for purposes not related to his professional activity, or making the purchase by requesting an invoice headed to a valid VAT number), has the right to terminate the purchase contract for any reason, without explanation and without penalty, subject to compliance with the conditions set out herein.
To exercise this right, the customer must send Mysecretcase.com a written notice to that effect, within 14 working days from the date of receipt of goods. This communication must be sent by e-mail toinfo@mysecretcase.com or to the public address of certified e-mail:mysecretcasesrl@pec.it
In the month of December the possibility of return for withdrawal is extended to 30 days from the date of delivery of the package.
Once the above-mentioned communication of withdrawal has been received, the Customer Service of Mysecretcase.com will quickly communicate to the Customer instructions on how to return the goods, which must be received by Mysecretcase.com within 10 days of authorization.
Theright of withdrawal is still subject to the following conditions:
- The right applies to the purchased product in its entirety.
- The purchased goods must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation, etc. ...).
- It must be avoided in all cases the affixing of labels or adhesive tapes directly on the original packaging of the product.
- The shipping costs for the return of the good are charged to the customer.
- The shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer.
- In case of damage to the goods during transport, Mysecretcase.com will notify the customer of the incident (within the 5th working day from receipt of the goods in their stores), to enable him to file a timely claim against the carrier of his choice and obtain reimbursement of the value of the property (if insured), in this case, the product will be made available to the customer for its return, while canceling the request for withdrawal; Mysecretcase.com is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments; upon its arrival (in stock), the product will be examined to assess any damage or tampering not resulting from transport. If the packaging and / or the original packaging are damaged, Mysecretcase.com will deduct from the refund due to a percentage, but no more than 10% of it, as a contribution to the costs of restoration.
- Without prejudice to any repair costs for damage to the original packaging, Mysecretcase.comwill refund the customer the full amount already paid, excluding shipping costs, within 14 days from the return of the goods (within 30 days in December). The refund operation will be carried out by Mysecretcase.com through the re-credit of the amount due.
The right of withdrawal lapses totally, for lack of the essential integrity of the good (packaging and / or its contents), in cases where mysecretcase.com ascertains
- The lack of the outer packaging and/or the original inner packaging.
- The absence of integral elements of the product (accessories, parts, ...).
- Damage to the product for reasons other than transport.
- In case of forfeiture of the right of withdrawal, Mysecretcase.com will return to sender the property purchased by charging the same shipping costs.
The right of withdrawal is excluded, pursuant to Article 59 letter. c) and letter. e) D. Lgs. 206/2005 (Consumer Code), in the case of customized and personalized goods and sealed goods that are not suitable to be returned for hygienic reasons or related to the protection of health.
Therefore, we willnotproceed with the refund of products only intended to come into contact with intimate parts (such as sex toys or underwear), if the package containing the product is found to have been opened or the product used in any way, in order to protect the health and hygiene of our users. The breaking of the "seal of guarantee" or any damage to the package will therefore prevent the exercise of the right of withdrawal for these products.
Warranty and complaints
All mysecretcase.com products sold by mysecretcase.com are covered by the manufacturer's conventional warranty and by the 24-month warranty for conformity defects, pursuant to Legislative Decree 206/05. In order to benefit from the assistance under warranty, the customer must keep the receipt or invoice (or the delivery note) that he will receive by e-mail in electronic format.
The exercise of the warranty may provide for the request for assistance to authorized service centers in the territory and / or follow the procedures outlined in the documentation inside the product packaging.
The manufacturer's conventional warranty is provided in the manner illustrated in the documentation inside the product packaging. If, following intervention by an Authorized Service Center, the defect is not covered by the manufacturer's conventional warranty, the customer will be charged for any costs of verification and restoration required by the Authorized Service, as well as transportation costs, if incurred by mysecretcase.com.
The guarantee of 24 months pursuant to Legislative Decree 206/05 applies to products that present a lack of conformity, provided that the product itself is used properly, in accordance with its intended use and as provided in the technical documentation attached. This warranty is reserved for the private consumer (a person who buys goods for purposes not related to his professional activity, or making a purchase without indicating in the order form a reference to VAT). In case of lack of conformity, mysecretcase.com. provides, without cost to the customer, the restoration of conformity of the product by repair / replacement or reduction of the price, until the termination of the contract. If, following intervention by an Authorized Service Center, the defect does not result in a lack of conformity pursuant to Legislative Decree 206/05, the customer will be charged for any costs of verification and restoration required by the Authorized Service, as well as transportation costs if incurred by Mysecretcase.com. Replacements in case of DOA (Dead On Arrival: product not working on delivery) occur only if expressly provided by the manufacturer. The timing of replacement or repair of the product depends exclusively on the policies of the manufacturer.
In the event that, for any reason, is unable to make its customers a product under warranty (restored or replaced), Mysecretcase.com. may proceed at its own discretion to refund the amount paid taking into account the use of the property or its replacement with a product of equal or superior characteristics.
The timing of repair or replacement of the product depends exclusively on the policies of the manufacturer and no damage can be claimed to mysecretcase.com for any delays in repairs or replacements.
In cases where the application of guarantees provides for the return of the product, the goods must be returned by the customer in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc. ...), to limit damage to the original package, we recommend to put it in a second box, should be avoided in all cases the attachment of labels or tape directly on the original packaging of the product.
The customer will be provided with an authorization number for the return of the product (RMA) which must be indicated on the outside of the packaging, following the instructions provided directly in the e-mail authorization. Any possible claim must be addressed to:

Applicable law and jurisdiction
This contract is governed by Italian law.
For the solution of civil and criminal disputes arising from the conclusion of this contract, if the customer is a consumer, the territorial jurisdiction is that of the reference hole of his town of residence, in all other cases the territorial jurisdiction is exclusively that of the headquarters of mysecretcase.com.
